OGF převezme exkluzivní právní kontrolu nad darem Microsoftu za vás. Poskytnuté dary jsou nevratné. Pokud vámi zvolená nezisková organizaci nemůže dar přijmout (například protože už nesplňuje kritéria účasti) nebo pokud je dar z jiných důvodů nepředatelný, hotovostní dar bude předán neziskové organizaci, kterou vybere Microsoft. Microsoft nijak neschvaluje činnost neziskových organizací.
